Terms of Service.

1. Acceptance of Terms

By accessing or using the OnlyGrams website at onlygrams.com or any related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

2. Eligibility

You must be at least 21 years of age, or the legal age for cannabis use in your jurisdiction, whichever is higher, to access or use the Services. By using the Services, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into and be bound by these Terms.

3. Use of the Services

The Services are provided for informational, educational, and personal use only. OnlyGrams is a strain reference and community platform. We do not sell, distribute, or facilitate the sale of cannabis or cannabis products.

The Services are not intended to provide, and do not constitute, medical, legal, or professional advice. You should consult with a qualified healthcare provider or other appropriate professional before making any decisions based on information obtained through the Services.

You agree to use the Services in compliance with all applicable laws, regulations, and these Terms. You agree not to:

  • Misuse the Services or interfere with their normal operation;
  • Attempt to gain unauthorized access to any part of the Services or any related systems or networks;
  • Use the Services for any unlawful purpose or in violation of any applicable laws or regulations;
  • Reproduce, duplicate, copy, sell, resell, or commercially exploit any portion of the Services without our express written permission;
  • Use any automated means (including bots, scrapers, or crawlers) to access the Services without our prior written consent;
  • Transmit any viruses, malware, or other harmful code through the Services;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

4. User-Submitted Content

By submitting content (including but not limited to reviews, comments, photos, notes, or other materials) to the Services (“User Content”), you grant OnlyGrams a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, modify, and create derivative works of such User Content in connection with the operation, promotion, and improvement of the Services.

You represent and warrant that:

  • You own or have the necessary rights, licenses, and permissions to submit the User Content and to grant the license set forth above;
  • The User Content does not infringe upon the intellectual property, privacy, publicity, or other rights of any third party;
  • The User Content complies with these Terms and all applicable laws and regulations.

OnlyGrams reserves the right, but is not obligated, to review, monitor, remove, or refuse any User Content at our sole discretion.

5. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the design, selection, and arrangement thereof, are the exclusive property of OnlyGrams or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any such content without our prior written consent, except as expressly permitted by these Terms or applicable law.

6. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND COURSE OF PERFORMANCE.

ONLYGRAMS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT INFORMATION PROVIDED THROUGH THE SERVICES IS ACCURATE, COMPLETE, RELIABLE, OR CURRENT. ANY RELIANCE YOU PLACE ON SUCH INFORMATION IS STRICTLY AT YOUR OWN RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ONLYGRAMS, ITS AFFILIATES, OR ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ONLYGRAMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification

You agree to indemnify, defend, and hold harmless OnlyGrams and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to (a) your use of or access to the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.

9. Modifications to the Services and Terms

We reserve the right to modify, suspend, or discontinue the Services, in whole or in part, at any time and without notice. We may also revise these Terms from time to time. Material changes will be communicated through the Services or via email where appropriate, and the revised Terms will be indicated by an updated “Effective Date” at the top of this page. Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of the revised Terms.

10. Termination

We may suspend or terminate your access to all or part of the Services at any time, with or without notice, for any reason, including without limitation if we believe you have violated these Terms. Upon termination, the provisions of these Terms that by their nature should survive termination will survive, including without limitation Sections 4 through 8 and 11 through 13.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OnlyGrams operates, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be resolved in the courts of competent jurisdiction in such location, and you consent to the personal jurisdiction of such courts.

12. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to render it enforceable, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by OnlyGrams on the Services, constitute the entire agreement between you and OnlyGrams regarding the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written.
